5 Things To Remember When Sponsoring a Tier 2 Migrant

Just recently, the government of the United Kingdom introduced a few changes to its Tier 2 (General) visa. This type of visa is for applicants outside the European Economic Area (EEA) zone and Switzerland who have received a skilled job offer from a legitimate firm in the UK. As it is always is after a policy update, we anticipate an increase in the number of confused applicants. Below are a few reminders every sponsor must remember when backing a foreign worker applying for a Tier 2 visa:
  1. As a sponsor, it’s your responsibility to assign the applicant a Certificate of Sponsorship (CoS) via the Sponsor Management System. The government advises that a CoS doesn’t guarantee success in obtaining a visa, but this will help the immigration office determine if the sponsored applicant meets all the criteria and requirements for this visa category.
  2. It’s imperative that you know everything about the applicant before issuing the employee a CoS. There have been cases in the past where the application was rejected simply because the applicant’s current immigrant status was not suitable for this type of visa. 
  3. Only one CoS can be issued per applicant.
  4. You are also expected to withdraw a CoS issued to an applicant who has decided to reject your offer and work for someone else instead.  
  5. You must also honour the “cooling off period” provided for this visa type. This means that an applicant can only reapply under the Tier 2 category after the expiration of his/her leave.  
As a sponsor, you have the full responsibility for all the duties, functions, and outcomes of the worker's employment. You serve as their link to the government. This is also the reason the government encourages the sponsors to not take the screening process for granted, and that sponsoring the best worker is always on top of their priority list. Your cooperation is also expected when the migrant working on a contractual basis is being moved from one organization to another.
